The essentials
Asserting a right is expensive in Switzerland: lawyers’ fees, advances on costs demanded by the courts, expert reports, and the other party’s costs if you lose. Legal protection insurance covers these expenses up to the sum insured and gives you access to legal specialists, from initial advice through to proceedings.
It covers private-life disputes, tenancy, employment contract, consumer matters, neighbourhood issues, and, in its road traffic component, the aftermath of an accident or a contested licence withdrawal. The two components are often combined in a single contract, with sums insured reaching several hundred thousand francs per case.
This insurance has to be taken out in advance: waiting periods apply after subscription, and a dispute that has already arisen is never covered. Some areas remain excluded, such as family or inheritance law. Comparing contracts on these precise points, not just on the premium, avoids unwelcome surprises at the decisive moment.

What is the waiting period in legal protection insurance?
It is the period after the contract is concluded during which certain disputes are not yet covered. Its length varies by area, often a few months for tenancy or employment matters, shorter or even absent for road traffic. Hence the point of taking out cover before any sign of conflict, not once it has broken out.
Can a dispute that is already under way be insured?
No. Legal protection insurance covers disputes whose cause arises after the contract is concluded and the waiting period has elapsed. A conflict that has already arisen, or was foreseeable at the time of signing, remains at your expense. That is the rule across the industry, and the reason this insurance has to be taken out in advance.
Are divorce or inheritance matters covered?
As a general rule, no: family law and inheritance law are among the classic exclusions of private contracts, as are tax law and disputes between people insured under the same contract. Some contracts do, however, provide one-off legal advice in these areas. We check these limits with you before you sign.
Can I choose my own lawyer?
Yes, as soon as judicial or administrative proceedings are under way, or in the event of a conflict of interest: you then appoint the lawyer of your choice. Before that stage, the insurer’s legal specialists first seek an amicable solution, which is often enough to settle the disagreement without going to court.
